Auto Insurance Lafayette Louisiana: Is It Ok to Lend My Vehicle in Every Circumstance?

In previous articles we have been discussing if it is okay to loan your vehicle to another individual not specifically listed on your automobile policy. We discussed that many companies allow permissive use. (But not all, check your individual policy)

In this article we will discuss a specific situation in which it would not be ok even though your individual policy allows permissive use.

Claims Scenario: Stephen Tyler, a fishing buddy of Fred Johnson asks to borrow Fred’s pickup truck to get back and forth to work while his car is in the shop being worked on.

Fred likes to help out his buddies in time of need so he gives Stephen the keys and tells him to keep the truck as long as he needs it.

Unfortunately two days later Stephen has a minor accident in Fred’s truck when making a delivery to a customer. Fortunately the damage isn’t bad and he calls Fred to let him know what happened and he promises to cover Fred’s deductible.

The claims adjustor from Fred’s insurance company speaks with Tiffany Camden, the person Stephen hit, taking her statement and information and next calls Stephen for his side of the story.

The claims adjustor writes up his report and sends it to their legal department.

Two days later the legal departments sends a claim denial to Fred Johnson and Tiffany Camden with a note to underwriting to cancel Fred’s insurance policy despite the fact he has been insured with them for over 20 years.

The damages to Fred’s pickup truck amount to around $1,850 and the other person’s car Stephen hit amounted to $2,319.

Fred needs to pay for the damages to his newer truck out of pocket, find a new insurance company and a fishing buddy, especially after he gets a bill from Tiffany Camden’s insurance company for $2,319 since Fred is the legal owner of the truck involved in the accident.

Stephen is nowhere to be found, his phone is disconnected, and he got fired from his pizza delivery job when he didn’t show up for work the next day.

Why did the insurance company deny the claim and Fred find himself on the hook to pay for an accident he never caused?
