Garage Keepers Insurance LouisianaIn a previous article we reviewed what happened to a vehicle owned by Sam Jones and being worked on by Benson Trusty Repair Shop.

Sam brought his Honda Pilot in to Benson Trusty Repair Shop so his timing belt and water pump could be replaced. Sam owns an HVAC Company and he puts about 40,000 miles per year on his vehicle as he is doing inspections and estimates for his customers.

After the repair work was finished the mechanic, Steve Cook, takes the Honda Pilot out for a test ride to make sure everything is sounding okay.

As Steve turns down on Main Street and stops at the traffic light, a 17 year old kid named Travis Henry is zipping down the street at about 50 miles per hour and sending a text message to his girlfriend Steffi at the same time.

Travis obviously isn’t paying much attention and at the last possible second slams on the breaks when he sees the stopped SUV and he hits the Honda Pilot going about 40 miles per hour.

Steve is initially stunned by the impact but unhurt as he squeezes out of the vehicle and runs back to see what happened to the other driver.

Travis is transported by helicopter to the local hospital. Both vehicles are totaled. Steve calls his boss Bill Benson, owner of Benson Trusty Repair Shop, to let him know what happened and that he also needs a ride back to the shop.

Bill makes a very uncomfortable call to his customer Sam to let him know what happened.

Bill assures Sam that he will call the claim into his insurance company but after hanging up the phone with Sam he isn’t 100% sure whether his policy covers this or not since he never had a situation like this before.

Bill calls his agent Jason to find out.

“Now here is the bad news, Bill, before we go off filing a claim,” Jason Harmen, Bill’s agent explains.

“You only have coverage under the Garage Keepers endorsement known as legal liability. Basically what that means is that your policy will only pay if you are legally obligated or responsible for the accident.”

“Did your driver cause the accident, Bill?” Jason asks.

“No, thank goodness he did not,” Bill states. “Some idiot kid hit my customer’s vehicle going way over the speed limit and they transported him by air care to the hospital. We have no idea what happened to the kid.”

“Hopefully he will be okay,” Jason replies. “However, because your mechanic Steve was not responsible for the accident, there’s no way your policy is going to pay the claim.”

“Well okay, Jason. Thanks for that information.”  Bill hangs the phone up and wonders how he’s going to explain this to his customer.
