Let’s dive back into our claims scenario illustrating the unexpected ways that knowing your policy can save you from making a costly mistake.

We return to our story featuring Chuck, the owner of Lucky Chuck’s Haul and Dump.

You’ll recall that Chuck lost his temper with a guy who cut him off on the highway and attempted to give the driver a scare. Chuck’s intention was to threaten to dump mud all over the driver’s sports car, but a control malfunction led to the load being dropped after all. Worse, the load wasn’t mud but chunks of concrete.

The red car was utterly smashed to pieces, the two drivers were arrested, and a passerby filmed the whole event and posted it online.

A few weeks later Lucky Chuck’s Tow and Dump is served a lawsuit naming Chuck as a defendant for destroying the sports car with his dump truck.

Chuck scoffs, confident that his full coverage on his dump truck will pay for the damage to the car since the whole thing was an accident.

To Chuck’s utter dismay, he receives notice from his insurance company that they will not be covering the claim, citing the following exclusion in Chuck’s commercial auto policy:

Coverage under this Part I, including our duty to defend, does not apply to:

Expected or Intended Injury – Bodily injury or property damage either expected by or caused intentionally by or at the direction of any insured.

Expected or Intended Injury describes any instance where injury or property damage directed toward any insured is either done intentionally or is expected.

In other words as far as the insurance company is concerned, regardless of Chuck’s true intentions his stunt with the dump truck can be seen as intending or expecting to cause damage or harm, so they are not obligated to cover him.
